Since the passage of the 2018 Farm Bill, the legal status of hemp and CBD has changed significantly. CBD derived from industrial hemp, with a THC concentration of not more than 0.3%, can now be legally produced, sold, and possessed in several states across the US.

In Alabama, according to a public notice updated by Attorney General Steve Marshall, CBD derived from industrial hemp is legal. The state has also launched its Industrial Hemp Research and Pilot Program. In Alaska, the legislature has approved an industrial hemp pilot program, but it has not been implemented yet.

Arizona, on the other hand, has a medical marijuana program and passed an industrial hemp law in 2019. The Arizona Department of Agriculture has begun issuing licenses to grow and process industrial hemp. Arkansas has laws instituting both a medical marijuana program and an industrial hemp program.

In California, while medical and adult-use of cannabis is legal, the status of CBD is still ambiguous. The California Department of Public Health released a FAQ in 2018 prohibiting the use of industrial hemp-derived CBD in food. Colorado, on the other hand, has a legal medical cannabis and adult use program, as well as an industrial hemp pilot program.

In Connecticut, a medical cannabis law has been established along with an industrial hemp pilot program. Delaware has both a medical cannabis program and an industrial hemp pilot program. In Washington, DC, medical cannabis and adult use is legal, but CBD derived from industrial hemp is not regulated under these laws.

Florida has a medical cannabis program and is in the process of implementing an industrial hemp pilot program. Similarly, Georgia state law includes a restrictive medical marijuana cannabis program and has passed an Industrial Hemp Farming Act in 2019. Guam has legalized medical cannabis and adult use.

Hawaii has a medical cannabis program and an industrial hemp pilot program, while Idaho does not have medical or adult use cannabis, nor has the state implemented an industrial hemp pilot program. In Illinois, an industrial hemp program specifically allows manufacturers to extract CBD. The state also legalized adult use in 2019.

Indiana does not have a medical marijuana law, but it does have an industrial hemp pilot program. In 2018, the state passed a law that allows any person to buy, sell and possess CBD Oil. Iowa has a medical CBD program and established an agricultural hemp program.

Kansas, however, does not have a medical cannabis program, and in 2018, the state enacted a law that removed any hemp products from the controlled substances list.
